Citation: On October 24, 2011, at approximately
07:55 hours, while performing an unscheduled Sanitation Performance
Standards (SPS) verification inspection procedure of the employee
restroom facilities located on the establishment’s second floor
between the maintenance and QC/HACCP offices, I observed that one
(1) of the two (2) employee toilet stalls at this location continues
to be made unavailable for use due to mechanical problems. Since
approximately 15:00 hours, yesterday, 10/23/2011, one (1) toilet at
this location is available for use by approximately one hundred ten
(110) employees, approximately one-third (1/3) of which are women.
In the firm's evisceration department, I noted that the drain of a
hand washing sink located near the automated lung gun machine is not
directly connected with plumbing to convey away waste water, which
instead flows onto the concrete flooring beneath and into a foot
traffic zone. I rejected the hand washing sink by affixing the Food
Safety and Inspection Service form 6502-1 #B40157510.
No edible product was seen to have been involved at the time of my
observations.
These observations constitute failures to comply with the United
States Code of Federal Regulations, Title 9, Chapter III, Animals
and Animal Products, Subchapter E, Regulatory Requirements under the
Federal Poultry Products Inspection Act, Part 416, Sanitation,
Sections 1, 2(e)(3), 2(h)(1), and 4(d). The establishment’s QC/HACCP
director, Mr. [redacted] was informed of the noncompliances upon
receipt of this document.
Federally-inspected food production establishments are required to
fulfill the expectations of all applicable requirements of the
United States Code of Federal Regulations and Food Safety and
Inspection Service. In this instance, management has failed to
maintain the integrity of plumbing at a hand washing sink allowing
waste water to flow into a foot traffic zone and make a sufficient
number of toilet facilities available for use by its employees.
This document serves as written notification that failure to comply
with regulatory requirements may result in additional regulatory
and/or administrative action(s).
Regulation:
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.2(e)(3) Plumbing. Plumbing systems must be installed and maintained to: Prevent adulteration of product, water supplies, equipment, and utensils and prevent the creation of insanitary conditions throughout the establishment;
416.2(h)(1) Dressing rooms, lavatories, and toilets. Dressing rooms, toilet rooms, and urinals must be sufficient in number, ample in size, conveniently located, and maintained in a sanitary condition and in good repair at all times to ensure cleanliness of all persons handling any product. They must be separate from the rooms and compartments in which products are processed, stored, or handled.
