Citation: September 26, 2011 09:05 hours While performing a scheduled, 03C02, HACCP raw, not ground, inspection procedure inside the establishment's new cooler, I observed three (3) plastic bulk bins each containing approximately one thousand (1,000) pounds of young chicken carcasses and parts and ice being stored on the concrete floor. The contents of each of the bulk bins were either completely unprotected or incompletely protected with plastic film. Upon closer examination, I encountered fourteen (14) instances of contamination residing directly on product. The contamination consisted of soil, fragments of wood, and unidentifiable foreign material ranging in size from 1/16 to 3/4 of an inch at its greatest dimension. One (1) of these bulk bins was situated directly beneath two (2) tiers of racks of Ready-to-Eat product palletized on wooden pallets that bore similar contamination. I retained the three (3) bulk bins by affixing the Food Safety and Inspection Service Forms 6502-1 #B39718866, #B39718867, and #B39718868. The processing department's co-manager, Mr. [redacted] was informed of the noncompliances after he observed these official regulatory control devices affixed to the affected product. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 417, Hazard Analysis and Critical Control Point Systems, Sections 3(b)(1) and 3(b)(2). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to ensure that product is protected while it resides in cold storage on the official premises. The failure resulting in direct contamination of poultry intended for use as human food. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

417.3(b)(1) If a deviation not covered by a specified corrective action occurs, or if another unforeseen hazard arises, the establishment shall: Segregate and hold the affected product, at least until the requirements of paragraphs (b)(2) and (b)(3) of this section are met

417.3(b)(2) Perform a review to determine the acceptability of the affected product for distribution;
