Citation: May 17, 2011 07:50 hours While performing an unscheduled operational sanitation inspection procedure in the tray pack room, I observed one (1) grey, plastic tote containing approximately two hundred (200) pounds of ice and located adjacent to the opening of the ice machine. All surfaces of the tote were scarred with cuts in which a reddish mold or algae was observed to be growing. On the interior surface of the tote, I also observed three (3) full and partial black boot prints. I rejected the plastic tote and retained its contents, both direct food contact surfaces, by affixing the Food Safety and Inspection Service Form 6502-1 #B39133044 to a stainless steel insert for the ice machine that was also observed inside the tote. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.4(a) and 416.13(c). I promptly notified the evisceration department's junior manager, [redacted] of the noncompliance verbally. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
