Citation: January 30, 2011 08:35 hours While performing a routine Finished Product Standards assessment inspection task in the evisceration department's reprocessing area, I observed approximately 65, whole, unsplit chicken carcasses in a black, plastic cart each tagged with a green plastic marker bearing the words, "Halal Poultry." I telephoned the QC/HACCP manager, Mr. [redacted] who was not present in the plant at the time, and asked him if management had secured permission from the Albany District Office to do business under the name "Halal Poultry" or had received third party certification confirming that their process and finished products qualify for the term "halal." Mr. [redacted] stated that the Albany District Office is in the process of reviewing an update to their grant of inspection to include the name, "Halal Poultry," and that representatives from a third party authorized to award certification for halal poultry products have visited the establishment, but that neither entity has yet handed down its decision and, further, that this establishment does not retain in its records documentation supporting this claim. I returned to the reprocessing area and retained the affected product by affixing the Food Safety and Inspection Service Form 6502-1 #B39718963. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Section 381.129, the FSIS Directive 7,000.1, Verification of Non-Food Safety Consumer Protection Regulatory Requirements, and the FSIS Food Standards and Labeling Policy Handbook. I promptly notified Mr. [redacted] of the noncompliances verbally. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

381.129(a) No poultry product subject to the Act shall have any false or misleading labeling or any container that is so made, formed, or filled as to be misleading. However, established trade names and other labeling and containers which are not false or misleading and which are approved by the Administrator in the regulations or in specific cases are permitted.
