Citation: July 6, 2010 07:52hrs While performing an operational inspection task in the establishment's small cooler, Food Safety and Inspection Service (FSIS) Inspector-In-Charge (IIC), [redacted] observed one perforated, strapped, waxed cardboard case containing 68.50 pounds of fresh young chicken, bearing the lot number 1018644 and packed in ice, sitting directly on the floor in a standing pool of water and poultry purge 3/8-inch deep. Inspector [redacted] applied FSIS Form 6502-1 #B38600540 to the product, retaining it, and promptly verbally informed shipping and receiving manager, Mr. [redacted] of the noncompliance. U.S. Code of Federal Regulations, Title 9, Chapter III, Section 416.4(d) states: "Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments." Inspector [redacted] instructed Mr. [redacted] either to have the product reworked at the processing department's reprocessing station under FSIS supervision or recommended that the product be condemned. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
